1. Who we are
YouMonit.com (the "Service") is operated by Webmint s.r.o. ("we", "us"), a limited-liability company registered in the Czech Republic, with registered office at Jana Želivského 2, 130 00 Praha 3, Czech Republic, European Union. 2. Acceptance of these Terms
By accessing or using YouMonit you agree to these Terms of Service ("Terms") and to our Privacy Policy. If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and Webmint s.r.o., enforceable in the Czech Republic and, for residents of the United States, governed by additional consumer-protection rules described below.
3. The Service
YouMonit provides website, API, network-service and SSL/certificate uptime monitoring, public status pages, free read-only network tools, related notifications and an HTTP API. Specific features and limits depend on your selected plan and may change over time. We perform routine maintenance and may suspend or degrade non-essential functionality for short periods; we will give reasonable notice for planned downtime.
4. Accounts and security
- You must be at least 16 years old (EEA/EU) or 13 years old (USA, COPPA) to create an account. Business accounts must be created by an authorised representative.
- You are responsible for safeguarding your credentials, API keys and webhook secrets, and for all activity that occurs under your account.
- You must provide accurate, current and complete registration information and keep it updated.
- We may suspend or terminate accounts that violate these Terms, applicable law, or that pose a security risk.
5. Acceptable use
You agree not to use the Service to:
- monitor or probe systems you are not authorised to monitor;
- generate excessive load, perform denial-of-service or distributed scanning;
- upload malware or use the Service to distribute unlawful, infringing, defamatory or harassing content;
- circumvent rate limits, plan quotas, authentication or billing controls;
- resell, sublicense or white-label the Service without a written agreement;
- violate any applicable law, including export controls, sanctions, or third-party rights.
6. Plans, fees and refunds
- Paid plans are billed via Stripe in advance, monthly or annually, in EUR, USD or CZK depending on the plan.
- EU consumers have a 14-day right of withdrawal under Directive 2011/83/EU. By starting to use a paid plan you expressly consent that the service starts during the withdrawal period; if you withdraw, we may charge a proportionate amount for the part already used.
- U.S. customers may obtain a refund of any unused, prepaid portion of an annual plan within 30 days of the initial charge by writing to support@youmonit.com.
- Taxes (VAT, sales tax, GST) are added where required by law. EU B2B reverse-charge applies when a valid VAT ID is provided.
- Failure to pay may result in suspension; data on a suspended account is retained for at least 30 days, then deleted.
7. Free tier and free tools
The free plan and the free network tools at /tools are provided "as is", without any service-level commitment. We may rate-limit, gate with reCAPTCHA, or temporarily disable them at any time. They are not intended for production-critical use.
8. Your data and content
You retain all rights to the data and content you submit ("Customer Data"). You grant us a limited, non-exclusive licence to host, transmit and process Customer Data solely to operate the Service. Our processing of personal data is described in the Privacy Policy; for EU customers it also constitutes a Data Processing Agreement under Article 28 GDPR.
9. Service level objectives
On paid plans we target 99.9% monthly availability for the checker network and the control panel, measured on a monthly calendar basis. Compensation for missed objectives is limited to service credit equal to the pro-rata daily fee for each full hour of qualifying downtime, capped at 30 days of fees per calendar month, and must be requested within 30 days of the incident.
10. Intellectual property
The Service, including its software, design, brand and documentation, is owned by Webmint s.r.o. and protected by Czech, EU and U.S. intellectual-property laws. Except for the limited licence we grant you to use the Service, no rights are transferred.
11. DMCA / copyright complaints
We respond to notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act, 17 U.S.C. § 512, and to equivalent EU notice-and-action requests. Send notices to support@youmonit.com with the subject "DMCA Notice" and include all information required by 17 U.S.C. § 512(c)(3).
12. Third-party services
YouMonit uses third-party processors (Stripe for payments, Mailgun for email, Twilio for SMS, Google reCAPTCHA for bot defence, Cloudflare for DDoS protection and CDN). Their use is necessary to operate the Service. See the Privacy Policy for the full sub-processor list.
13. Warranty disclaimer
Except as expressly set out in these Terms, the Service is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties; in those jurisdictions the foregoing exclusions apply only to the extent permitted.
14. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, goodwill or data. Our total aggregate liability arising out of or related to the Service in any 12-month period will not exceed the greater of EUR 100 or the fees you paid in the 12 months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law (e.g. for gross negligence, wilful misconduct, death or personal injury, or under mandatory consumer-protection law).
15. Indemnification
You agree to defend, indemnify and hold harmless Webmint s.r.o. and its officers, employees and agents from any claim, loss, liability or expense (including reasonable legal fees) arising from your use of the Service in breach of these Terms or applicable law, or from Customer Data you submit.
16. Termination
Either party may terminate the agreement at any time. We may terminate or suspend your account immediately for material breach, non-payment or risk to the Service. On termination, your right to use the Service ceases; we will retain Customer Data for 30 days for export, after which it will be deleted from active systems. Encrypted backups roll off within 90 days.
17. Changes to the Terms
We may update these Terms from time to time. Material changes will be announced by email and on this page at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
18. Governing law and disputes
For EU/EEA customers these Terms are governed by Czech law, excluding its conflict rules. Mandatory consumer-protection rules of the customer's country of residence apply. The courts of Prague have exclusive jurisdiction, save for any non-waivable rights of consumers. EU consumers may also use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
For U.S. customers, except where prohibited, the parties agree to resolve disputes first by good-faith negotiation, and, failing that, by binding individual arbitration administered by the American Arbitration Association under its Commercial Rules, seated in Wilmington, Delaware. Either party may bring an individual action in small-claims court. CLASS ACTIONS AND CLASS ARBITRATIONS ARE NOT PERMITTED. You may opt out of arbitration by emailing us within 30 days of first accepting these Terms.
19. Miscellaneous
If any provision of these Terms is held unenforceable, the remainder will continue in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor in connection with a corporate transaction. These Terms, together with the Privacy Policy and any plan-specific addenda, constitute the entire agreement between the parties.
